Discussion # (POSU). Discussion # (POSU). In the case of Miller v. Alabama, the Supreme Court ruled that mandatory life without parole (LWOP) for juveniles constituted cruel & unusual punishment. However, the judge has the option to sentence a juvenile to LWOP; the state just cannot make it a mandatory sentence.
Discuss your feelings of mandatory LWOP for juveniles. Are there some children that are so beyond rehabilitation that they should never have a chance at parole, or should all juveniles have at least the chance at release?
